This Privacy Policy explains how Be Design collects, uses, stores and protects personal information in accordance with the New Zealand Privacy Act 2020.

Be Design is a web and graphic design business based in Christchurch, New Zealand, providing services to clients in New Zealand, Australia and other countries.

Information we collect

We may collect personal information when you:

  • engage Be Design to provide services;
  • supply information, files or website access for a project;
  • provide feedback, a testimonial or other project-related information; or
  • otherwise communicate or work with us.

Depending on the circumstances, this information may include:

  • business or organisation name;
  • email address and phone number;
  • website address;
  • information about your business, website or proposed project;
  • correspondence and project instructions;
  • files, photographs, website content and brand assets;
  • account or website access details you provide for project purposes;
  • billing and transaction information; and
  • any other information you choose to provide.

Please do not provide sensitive personal information unless it is genuinely required for your project.

Information collected automatically

When you visit this website, certain technical information may be collected automatically. This can include:

  • your IP address;
  • device and browser type;
  • approximate geographic location;
  • pages viewed;
  • the date and time of your visit;
  • how you arrived at the website; and
  • how you interact with the website.

We use Google Analytics to help us understand how visitors use the website and how its content and performance can be improved.

Google Analytics uses cookies and similar technologies. The information collected may be processed by Google on servers located outside New Zealand.

You can restrict or disable cookies through your browser settings. Doing so should not prevent you from viewing the website, although some features may not work as intended.

Why we collect your information

We collect and use personal information where it is reasonably necessary to:

  • respond to enquiries;
  • determine whether Be Design is the right provider for a project;
  • prepare quotes, proposals and agreements;
  • provide web design, graphic design, website management and related services;
  • communicate with clients about their projects;
  • manage files, feedback and project approvals;
  • provide support and maintain client websites;
  • issue invoices and maintain business records;
  • improve the website and our services;
  • protect the security of our website, accounts and systems;
  • meet our legal, tax and accounting obligations; and
  • resolve complaints or disputes.

We will not use your personal information for purposes unrelated to those for which it was collected unless you authorise us to do so or the use is otherwise permitted by law.

Be Design does not currently operate an email newsletter or use personal information for bulk email marketing.

How we collect information

We generally collect personal information directly from you.

Occasionally, we may receive information about you from another person or organisation—for example, when someone refers you to Be Design, introduces us by email or provides contact information on behalf of their organisation.

Where required, we will take reasonable steps to make sure you are aware that we have collected the information, why we collected it and how it will be used.

This reflects Information Privacy Principle 3A, which applies when an organisation collects personal information from someone other than the person concerned. (Privacy Commissioner’s IPP3A guidance)

Website enquiries

Website enquiry forms are processed using Elementor. Information submitted through these forms may be:

  • stored temporarily or permanently within the website;
  • sent to Be Design by email; and
  • transferred to other business systems where necessary to respond to your enquiry or manage a project.

You are not legally required to provide information through an enquiry form. However, if you do not provide the information marked as required, we may be unable to respond properly or assess your project.

Payments

Be Design does not collect payment card details directly through this website.

Some clients may make payments through PayPal. When you use PayPal, your payment is processed according to PayPal’s own terms and privacy policy. Be Design may receive transaction details such as your name, email address, payment amount, currency, date and transaction status, but does not receive your full payment card details.

How we store and protect information

Personal information may be stored in:

  • the Be Design website and Elementor form submissions;
  • email and Google Workspace;
  • Google Drive;
  • Dropbox;
  • project, accounting and business administration records; and
  • secure devices and backup systems used by Be Design.

We take reasonable steps to protect personal information against loss, unauthorised access, misuse, alteration or disclosure. These steps may include password protection, access controls, two-factor authentication, software updates, secure connections and reputable cloud service providers.

No internet transmission or storage system is completely secure. We cannot guarantee absolute security, but we take reasonable precautions appropriate to the information we hold.

Overseas storage and service providers

Some of the service providers used by Be Design are based outside New Zealand or may store and process information on overseas servers. These may include:

  • Google, including Google Workspace, Google Drive and Google Analytics;
  • Dropbox;
  • PayPal;
  • website hosting, backup and security providers; and
  • other technology providers necessary to deliver our services.

Where an overseas provider stores or processes information on our behalf without using it for its own purposes, it may be acting as our agent. Where personal information is disclosed to an overseas organisation for its own use, we will take reasonable steps to ensure that the disclosure complies with Information Privacy Principle 12.

Who we share information with

We do not sell or rent personal information.

We may share information where reasonably necessary with:

  • contractors or specialist providers assisting with a project;
  • website hosting, software, cloud storage and technical service providers;
  • payment, accounting or professional advisers;
  • government or regulatory authorities where required by law; or
  • another party where you have authorised the disclosure.

We only share information for the purpose for which it was collected, for a directly related purpose, with your permission or where disclosure is otherwise permitted or required by law.

Client websites and third-party information

When Be Design works on a client website, we may have access to personal information controlled by that client—for example, customer accounts, website enquiries, order information or mailing-list data.

In those situations, Be Design generally handles the information only as necessary to provide services to the client. The client remains responsible for deciding why and how its customer information is collected and used, including providing its own privacy policy where required.

We ask clients not to give us access to personal information that is unnecessary for the work being performed.

How long we keep information

We retain personal information only for as long as it is reasonably required for:

  • the purpose for which it was collected;
  • providing ongoing services or support;
  • maintaining appropriate project and business records;
  • meeting legal, tax and accounting obligations; or
  • resolving disputes or enforcing agreements.

When information is no longer reasonably required, we may securely delete, anonymise or destroy it.

Website enquiry submissions may be periodically deleted from the website once they are no longer needed.

Accessing and correcting your information

You have the right to ask what personal information Be Design holds about you and to request a copy of that information.

You may also ask us to correct information that is inaccurate, incomplete or out of date.

To make an access or correction request, email barbi@hellobedesign.com. We may need to verify your identity before releasing or changing information.

In most circumstances, organisations should not charge people for accessing or correcting their personal information. (Privacy Commissioner’s access guidance)

Privacy breaches

If a privacy breach occurs, we will take reasonable steps to contain and assess it.

Where a breach has caused or is likely to cause serious harm, we will notify the Office of the Privacy Commissioner and affected individuals as required by the Privacy Act 2020.

Links to other websites

This website may contain links to websites operated by other organisations. Be Design is not responsible for the privacy practices, security or content of those websites.

We recommend reviewing the privacy policy of any external website before providing personal information.

Changes to this policy

We may update this Privacy Policy when our services, website tools or legal obligations change.

The current version will be published on this page with the date it was last updated. If we introduce additional tracking or advertising tools, such as Meta Pixel, we will update this policy to explain what information those tools collect and how it is used.
